Due amount recovery

Simply, it is the process where the amount due between the parties is recovered using civil methods. It is different from the criminal method as it requires a civil suit to be filed before Civil Court with a court fee. In this process too, the procedure to be followed before the civil court having territorial jurisdiction. No kind of any detention is provided in this method.

Civil Suits

Other than all those activities which are not criminal in nature are decided on filing of the petition before a civil court having jurisdiction. In all Civil matters, the application with the court fees is filed with the court having the jurisdiction (monetary, territorial & the subject matter involved). The court, on compilation of the due process, passes Decree to be followed by the Parties concerned.

Cheque Bounce

A Complaint is to be u/s.138 N.I.Act. On receipt of the information of the dishonour of a cheque, a notice within 30 days is to be sent over the person who has issued the said cheque. Instead of waiting for any replies, on completion of around 15 to 20 days, a complaint under section 138 of the Negotiable Instrument Act is being filed with the court having territorial jurisdiction over the matter to try and adjudicate.

In maximum cases, a settlement usually takes place; and if the matter is not settled, the court passes the order based up on the evidence, Fact & circumstances. A penalty of double of the cheque amount along with an imprisonment are the provisions for default against the issued check.

Criminal Complaints

An act which is done with an intent to harm the persons is called as a criminal act and in the remedies a complaint to be called as criminal complaint being filed with the court having the jurisdiction for the Losses sustained by the agreed party. In a criminal complaint, instituted against the person individually or against a group where each and every has its role in completion of the crime, the financial penalties along with an imprisonment is provided against a criminal act which is to be decided by the court.

Consumer Complaint

The complaint against failure in services is called as a consumer complaint and is filed before a consumer court called as Consumer Forum. In this type of complaint, a failure in providing of the services or Goods/articles/products is the basic issue which is remedied by the payments against the failure. The complaint is filed with the consumer court with all those facts clearly defining the failure by the service provider/ supplier along with a demand. There are several consumer complaints are being filed and are being adjudicated and decided by the courts to safeguard the interest of the people against those, who are violating and not providing and not following and not full filing the promises towards the consumer. It must be noted that a company is not a consumer whereas a person who is benefited of the products or services is a real consumer whose rights are being protected by the consumer courts under the law.

RERA, Real Estate case

Real Estate Regulatory Authority is formed by the government under legal provisions. It includes the provisions related with the real estate matter like flat, buildings, farms, developers, builders and the authority under the state government. A complaint for the redressal of any wrong being committed by the developer / builder is filed by the person aggrieved which is being decided by the authorities at the Rera. Basically, the problems of late position, wrong & party construction, discrepancy in payment against the flat / area sold and developed is there. For all such kind of problems a complaint being filed with Rera authorities which at the earliest possible but within 6 months decide and passes the appropriate order.
