Cheque Bounce

A Complaint is to be u/s.138 N.I.Act. On receipt of the information of the dishonour of a cheque, a notice within 30 days is to be sent over the person who has issued the said cheque. Instead of waiting for any replies, on completion of around 15 to 20 days, a complaint under section 138 of the Negotiable Instrument Act is being filed with the court having territorial jurisdiction over the matter to try and adjudicate.

In maximum cases, a settlement usually takes place; and if the matter is not settled, the court passes the order based up on the evidence, Fact & circumstances. A penalty of double of the cheque amount along with an imprisonment are the provisions for default against the issued check.
