Trademark Registration procedure – An application for registration of a trademark including the Label/Logo/Slogan/Punchline/Tagline etc. will be filed before the Registrar of Trademarks under territorial jurisdiction with the supporting documents. Application gets a Formality check passed followed with the Examination & hearing. On approval, Acceptance & Advertisement, getting registration for 10 years. For Registration, an application is filed under section 18(1) on FORM TM-A with the Label/logo, the user affidavit, the Authority Letter and others along with the Govt.
Once an application is filed, the applicant can start use of its trademark using ™ mark with its trademark and after the issuance of the Registration certificate the applicant can use the symbol R over its trademark.
